Club4TravelBuddies club4travelbuddies.com (web and mobile application) and its services are published by the company K Hub Ltd - St. Cyril and Methodius Street, N 32, Gabrovo Bulgaria | VAT: BG206176366. Club4TravelBuddies operates using the entire database on the network or only parts of it. By registering or subscribing the user will become part of the network. Club4TravelBuddies members commit themselves to abide by the following Terms and Conditions. In case those conditions are not accepted, one cannot become a Club4TravelBuddies member. In order to sign up for one or more Club4TravelBuddies services and use this site, it is assumed that the member has fully accepted these conditions. By registering the Member declares that to be fully informed and is considered to be bound by all the provisions of these Terms and Conditions. By subscribing the service (both free and/or paid subscription) you warrant, and covenant that you are are at least 18 years old or the age of majority in your jurisdiction

Article 1. definitions

The following words or expressions, in these Terms and Conditions, bear the following meanings. Club4TravelBuddies: Multi-access Dating-service with a fee, released by K Hub Ltd - St. Cyril and Methodius Street, N 32, Gabrovo Bulgaria | VAT: BG206176366. Some of Club4TravelBuddies services are free of charge whereas other functionalities require a fee. AD NETWORK: a complex of dating sites with full and partly shared database, published by K Hub Ltd - St. Cyril and Methodius Street, N 32, Gabrovo Bulgaria | VAT: BG206176366; Membership: Method of payment to enjoy the services provided by Club4TravelBuddies. Fees: Contract types, stipulated to enjoy the Club4TravelBuddies services Furthermore, are foreseen also special service packages and offers. Member: The user has properly signed up for Club4TravelBuddies services, independently of a subscription fee.

Article 2. Club4TravelBuddies access and membership

In order to register to this website, it is necessary to accept the Terms of Use related to the services provided by Club4TravelBuddies. All the costs related to the equipments and their use (computer, apps, telecommunication means, etc.), which give access to the Services, are entirely at the expense of the Subscriber. In order to become a Club4TravelBuddies Member and thus of the network, it is necessary to be at least 18 years old and fill out all the mandatory fields of the sign-up form. The Member guarantees that the information provided is accurate and corresponds to the truth. The Member shall immediately inform Club4TravelBuddies of any change to the information entered during the sign-up process or, if it is needed, shall make the necessary changes in the personal area under the section "profile" at Club4TravelBuddies site. If the mandatory conditions for signing-up are met, every Member can choose a nickname and set a password for each profile for which a username has been activated. Users may create and manage more than one personal profile, but they will have to buy a subscription for each profile with which they want to operate at the Club4TravelBuddies platform. Usernames and passwords are strictly personal and confidential and must not be divulged or disclosed to third parties. Club4TravelBuddies cannot be held liable under any circumstance for the loss of username and/or password by the Member. Should a Member forget his/her password, he/she can file a request to Club4TravelBuddies by simply entering his/her nickname at the appropriate form and submitting it. Club4TravelBuddies shall send an email to the address provided by the Member containing the password corresponding to the nickname. Should a Member divulge or use his/her access credentials against their purpose, Club4TravelBuddies reserves the right to close this Member's account without any notice. However, Members have the right to change or edit their password as they wish. Club4TravelBuddies's records will only keep the last password entered and those used in the past will be replaced with the newest one. Members must confirm the accuracy of the email address provided during the sign-up process by replying to a confirmation email sent by Club4TravelBuddies staff. Should a Member fail to reply to the confirmation e-mail in a fortnight after signing up, he/she cannot access to all the services and Club4TravelBuddies reserves the right to delete his/her profile. The Member is the sole responsible for the use of his/her credentials by third parties or actions or declarations done using their personal account, whether they are fraudulent or not. Thus, the Member binds himself/herself to keep Club4TravelBuddies unharmed from and to indemnify Club4TravelBuddies for any third-party claims. Club4TravelBuddies does not have the means to guarantee the identity of those who sign up for its Services, therefore, it is not liable in case the identity of a Member is abused. If a Member has grounds to believe that third parties are using his/her access credentials or his/her account, he/she must inform Club4TravelBuddies about it immediately. If a Member wants to introduce a friend and provides Club4TravelBuddies with his/her personal information, the Member is obliged to obtain an explicit consent from that friend in advance so that Club4TravelBuddies can process his/her personal information, which will be used exclusively to send him/her an electronic message to inform him/her of Club4TravelBuddies and its Services in the name and on behalf of the Member who provided Club4TravelBuddies with his/her personal information. The Member is also responsible for that friend before Club4TravelBuddies and third parties, as well as for the consequences arising from the transmission of his/her personal information to Club4TravelBuddies. Access credentials of Members who have not been using the service may be deleted 6 months after the last valid access to Club4TravelBuddies site. Furthermore, Club4TravelBuddies reserves the right to deactivate the profiles of Members, who have not replied to the confirmation e-mail sent to the email address that they entered on the registration form, after the first step of the sign-up process, within a period of fifteen days, starting from the date the sign-up confirmation email is sent by Club4TravelBuddies system. Club4TravelBuddies reserves the right to delete Member's messages 6 months after their sent date.

Article 3. use of Club4TravelBuddies
3.1 Code of conduct and anonymity

After Members sign up for the service and pay the subscription fee of their choice, they can access services available at Club4TravelBuddies. Members can access the prices and payment methods for the services available at a later moment, while viewing and using the services that they want to sign up for, as well as while viewing and using the corresponding fees. While using the service, the Member commits him/herself to abide by the following rules in particular: Comply with the law and the rights of others. Do NOT use Club4TravelBuddies for professional, commercial or non private purposes (client search, etc) or for illicit, illegal, immoral, indecent scopes or against public order. Publish, disseminate, or broadcast information or content of any kind which corresponds to the truth. Do not declare, use expressions or divulgate content in any form that violates third-party rights or any slanderous, abusive, obscene, pornographic, pedopornographic, offensive, violent or inciting violence, political, racist or xenophobic content and, in general, any content not compliant with the subject matter of Club4TravelBuddies, laws in vigor, public order, personal rights, morals and protection of minors. In particular, photographs, videos and any other information, data or file supplied by a Member to Club4TravelBuddies must be decorous and refer to the Member exclusively or, in case they regard a third party, they must include their explicit authorization under the exclusive responsibility of the Member concerned. Do not communicate any personal information (electronic address, mail address, telephone number, etc) at Club4TravelBuddies site that might allow a Member to contact another Member without having to use Club4TravelBuddies. Do not publish, disclose or broadcast information or content in any form that could diminish, disorganize or prevent the regular use of the Services, interrupt and/or slow down the regular transmission of the messages between Members by means of the Services, such as applications, viruses, Trojan horses, sending mass messages (spam), etc. Club4TravelBuddies reserves the right to eliminate messages sent by a Member in bulk in order to make sure that other Members can use the services at a proper quality level. Do not publish, disclose or broadcast information or content in any form, which contains advertisement of any kind or links to other websites. Without prejudice to the provisions of the article "Termination of the contract", if a Member infringes one or more of these conditions, Club4TravelBuddies reserves the right to block the account of that Member, automatically delete the controversial messages or content independently of their nature, prevent the profile of that Member from being completely or partially published and/or block that Member's access to the Services completely or partially, temporarily or definitively, without any compensation or reimbursement and reserves the right to make recourse against that Member. Club4TravelBuddies cannot be held liable for false declarations made by a Member. Therefore, we recommend Members to take precaution when meeting other Members. Club4TravelBuddies does not take any liability for meetings between Club4TravelBuddies Members, at Club4TravelBuddies site or during meetings between Members and non-Members, as a consequence of the use of Club4TravelBuddies site and its Services. To that matter, Club4TravelBuddies reminds its Members that they cannot disclose or divulgate information to other Club4TravelBuddies Members at Club4TravelBuddies site which can be used to identify them, such as their last name, mail or email address and telephone number. Furthermore, should you want to meet another user whom you have met at Club4TravelBuddies, we recommend you to inform a friendly person and give preference to public places (cafés, restaurants, etc). In order to safeguard and protect its users, Club4TravelBuddies has an available service which avoids the Internet drawbacks. Apart from the regular and continuous controls on the service quality; to prevent a Club4TravelBuddies user from suffering the attraction and fascination with the possibilities of transgression or other, the service operators strongly advised to stick to the following classic handbook : It is a good idea to get to know each other, especially by email, before exchanging personal information (telephone number, home or office address). We recommend you never tell anyone your home address. Should you decide to call a person whom you met on the Web, it is a good idea to hide your caller ID on your telephone so that your number will not be seen on the receiver's telephone. If you want to stop communicating with someone, let them know immediately and gently, but be decided in doing so. On club4travelbuddies.com site or on the web-application for smartphones users can create their profile by using a pseudonym (nickname). The email address that they are requested to enter will not be disclosed to other users. Any further contact will be done using internal services. The Member's identity will always remain protected, as long as the concerned member decides not to disclose it to other members. Signing up to the portal is strictly reserved to adult users and completely free of charge. Members can complete their profiles during the registration steps, add photos, fill out their private areas and post a presentation. The subscribers can subscribe the subscription formula, which suits them the most, by credit card payment or other payment methods, depending on the user's country. Club4TravelBuddies allows its Members to consult the files of other people who are also Club4TravelBuddies members or other sites or applications of AD NETWORK. Club4TravelBuddies reserves the right to charge different fees or offer free access to some categories of subscribers or during particular promotions. In any case, the services price and payment methods can be viewed at Club4TravelBuddies site any time and, also while viewing and using the Services that the Member wants to subscribe for, as well as while viewing and using the corresponding fees. The price and modality of the various services are available when viewing and using the services to which the Member wishes to subscribe.

3.3 Automatic renewal of the membership

When purchasing one of the subscription formulas on the Internet by credit card, it will be renewed automatically for the same period of time chosen, unless the Member cancels it by sending a message using the contact form under the "Contact us"section or sending an email to [email protected] or phone to +44(151)9470037, by the following deadlines: Not later than 24 hours prior to the subscription expiry

3.4 Paid features

Purchase of a Subscription allows access to the features described on the Websites. All features of these Upgrades will be described on https://Club4TravelBuddies/subscribe Anyway prices are described as follows:

Silver Membership Total 3 days 1,5 EUR /1,5 GBP / 1,5 USD / 1,5 CAD / 1,5 AUD / 1,5 SGD - including VAT If no cancellation is made within the 3 days trial period, membership will be automatically extended and every 30 days a membership fee (49,99 EUR / 49,99 GBP / 49,99 USD / 69,99 CAD / 79,99 AUD / 79 SGD including VAT) will automatically be deducted from Member`s credit card, unless a cancellation request is made by the Member. Cancellation request can be made by sending a message in the "Contact us" section according with the procedure and terms explained in Terms and Conditions (section 3.3 Automatic renewal of the membership).

3.5 Refund Policy/Cancellation

You get a 14-day cooling-off period on any subscription purchase. To request a refund just ask our "Contact us"section or sending an email to [email protected] or phone to +44(151)9470037 Please note that refunds are available for purchases of first-time subscriptions. No refunds will be given for renewals. If you don't want to continue with your subscription, you can cancel the automatic renewal sending a message in "Contact us" section or writing an email to [email protected] or phone to +44(151)9470037

Article 4 Contents divulgated by Club4TravelBuddies

All intellectual and industrial property rights, protected based on copyright laws or other provisions concerning software, programs and computer systems regarding the Service, Club4TravelBuddies's site and/or databanks, made available to the user or member in any form or format, will continue to be the exclusive property of Club4TravelBuddies, which grants the user or member a non-exclusive, non-transferable end-user personal license in compliance with these Terms and Conditions. The right to use is strictly limited to the access and to the on-line use of Club4TravelBuddies site and services for private and personal uses exclusively pertaining to and during the validity of Club4TravelBuddies membership. Any other use is prohibited. In particular, members or users cannot edit, copy, reproduce, download, broadcast, transmit, make commercially use of and/or distribute services and content of Club4TravelBuddies site or the computer programming codes of the elements that make up the services and Club4TravelBuddies site by any means.

Article 5. termination of contract and profile removal

Every Member can resign from the contract at any time and therefore terminate their Club4TravelBuddies membership without specifying the reason, by filling out the form under the "Contact us" section. The profile will be deleted within 15 days after the request has been submitted. Once the Member rescinds from the contract, Club4TravelBuddies shall retain any amount already paid for unused parts of membership premiums and fees, without prejudice to the provisions of art. 3, under paragraph "cancellation of automatic membership renewal". Without prejudice to other provisions of these conditions, in case the Member violates this regulation, Club4TravelBuddies reserves the right to suspend his/her account or terminate the contract by law without notice and refund and/or raise legal action against the Member. Such a termination will have full effect, without prejudice to Club4TravelBuddies's right to take legal action against the Member or his/her assignors to claim for indemnification for any damage suffered as a consequence of the improper use of the service. The Member will be informed of the termination or the confirmation of the termination of his/her account by email. Data pertaining to the Member will be destroyed immediately after he/she makes an express request or by the deadline foreseen by Swiss legislations concerning the conservation of personal data.

Article 6. Liabilities and Warrantees
6.1. Information and content provided by Members

The data provided by a Member to Club4TravelBuddies must be accurate and correspond to the truth. The Member is exclusively liable for the consequences to the Member's and/or other Members' lives arising from divulgating them. Club4TravelBuddies cannot be held liable for the correctness or imprecision of the information and the content provided by Members and/or visitors of the site and/or the Member and consequences arising from them. Likewise, Club4TravelBuddies cannot be held liable for the contents divulgated by a Member that might breach the rights of one or more other Members or third parties. Should Club4TravelBuddies be held liable for the violation of the obligations arising from the law in vigor and these Terms and Conditions by a Member, the Member shall seek to keep Club4TravelBuddies unharmed from and indemnify Club4TravelBuddies against any claim.

6.2. Functioning of Club4TravelBuddies site and relative services

The Member must have the applications and make the necessary settings for Club4TravelBuddies to function correctly: browser IE6 or higher, activating JavaScript functions, receiving of session cookies and accepting to view pop-up windows. Club4TravelBuddies does not guarantee that the services can be used if the Member uses a pop-up window blocking utility. In that case, this function will have to be deactivated before using Club4TravelBuddies. Furthermore, the Member must have the necessary competences, tools and appliances to use the Internet and, if necessary, Internet and telephone services, and acknowledge the extent to which the characteristics and constraints of the Internet allow for guaranteeing the protection, availability and integrity of data transmission over the Internet. Under these terms, Club4TravelBuddies does not guarantee that the services shall function without interruptions or dysfunctions. In particular, their use can be temporarily interrupted for maintenance, update, technical improvement reasons, to change the content or their presentation. Club4TravelBuddies shall inform the Members of a maintenance or update operation in advance, as much as possible. Due to the specificity of their Internet browsers, AOL, Safari - Mac users may have problems using the service. Club4TravelBuddies will not be liable for the dysfunctions caused by the connection via these access providers under any circumstance. Equally, Club4TravelBuddies cannot be held liable for malfunctions, impossibility to access Club4TravelBuddies or bad conditions of Club4TravelBuddies site use that could be ascribed to an inadequate tool, internal dysfunctions of the Member's access provider, the Internet traffic and any other reason that does not depend on Club4TravelBuddies.

6.3. Limitation of Responsibility

The global responsibility of Club4TravelBuddies is limited to the amount actually paid by the Member for the service subject to a violation. Club4TravelBuddies cannot be held liable for indirect damages suffered by the Member under any circumstance, and in particular, for data loss, damages to the image, reputation, etc. (also for the copies) or registrations done by the Member, since the Member is responsible for making backup copies.

6.4. Links

Club4TravelBuddies site or third parties could include hypertext links to other web sites or other Internet sources other than Club4TravelBuddies site. Since Club4TravelBuddies cannot control those sites and outside sources, it cannot be held liable for their availability, content, advertisements, products and services or any other element available in or starting from those sites or external sources. Any dysfunction regarding a link must be communicated to the administrator or the webmaster of the site concerned Consulting and/or using those sites and external sources are governed by their specific end-user conditions. If the result of the search done at Club4TravelBuddies site leads the Member to visit other sites, pages or forums whose title and/or content amount to violating any applicable law, the Member must stop viewing/visiting that site immediately. Otherwise, he/she shall be held liable for his/her own actions, and Club4TravelBuddies will take no responsibility.

Article 7. agreement between the Member and Club4TravelBuddies

These Terms and Conditions and the pages of Club4TravelBuddies site mentioned in these regulations constitute the contract that governs the relationship between the Member and Club4TravelBuddies. They annul and replace all previous provisions that have not been expressly written or attached and comprise the set of rights and obligations of Club4TravelBuddies and the Member.

7.1 INDEMNITY BY MEMBER

You agree to indemnify and hold harmless the Company against all claims, expenses and costs (including legal costs) incurred or suffered by us as a result of or in connection with (i) your breach of this Agreement; (ii) any allegation that any materials that you submit to us or transmit to the Website infringe or otherwise violate the copyright, trademark, trade secret or other intellectual property or other rights of any third party; and/or (iii) your activities in connection with the Website unless as a result of your compliance with our requirements.

Article 8. Terms and Conditions modifications

Club4TravelBuddies reserves the right to change or have the Club4TravelBuddies site pages , Services, their price and applicable Terms and Conditions changed at any time. These modifications will be effective as of when they will be online on Club4TravelBuddies site, except for the right of any Member to resign from the contract in case they do not accept the changes made and cancel his/her membership with Club4TravelBuddies. In case the Member does not exercise his/her right of rescission, it is assumed that the Member has accepted these changes and continues to use Club4TravelBuddies site or its Services. Therefore, the Members are invited to consult the version which is constantly online on the site. If a Member is online and connected to the site, it means that he/she has fully accepted all the revision or amendments to these regulations.

Article 9. Banned users

If Club4TravelBuddies users do not comply with these Terms and Conditions or where will be found and/or reported abnormalities of use of the service, the staff in charge will provide a test that could lead to the insertion of the user in the "Banned"category. If a user is inserted among the banned users, attempting to log in the message "you have been banned for violating the Club4TravelBuddies policy" will show, and therefore they can not access the portal. They may contact the staff to ask for explanations and eventually report the error. If there is error on the part of the staff, the user will immediate be re-enabled, otherwise these users will be permanently deleted after 15 days from the insertion in this category.

Article 11. Payment methods

Users can subscribe to the full service features using credit and debit cards issued by VISA and Mastercard authorized partners banks.

Article 12. Entertainment Service

The Service is an entertainment service offered for amusement purposes. You understand, acknowledge and agree that some profiles appearing on the Site may be fictitious, created or operated by the Site or third party contractors. The purpose of these types of profiles is to stimulate conversation with users and encourage further and broader participation in all of our Site's Services. In addition, these types of profiles serve to sample user activities and communications to ensure compliance with our Terms of Service/ User Agreement. You understand, acknowledge and agree that said profiles do not pertain to any actual person, but are included in the Service for the reasons stated hereinabove. Any similarity between such fictitious profiles and any real person, living or dead, is purely coincidental. You further understand, acknowledge and agree that the Service personnel or contractors may contact Members, from time to time, via computer generated instant messages or emails for purposes of encouraging further or broader participation in the Service. Such messages and emails can also serve the purpose of monitoring user activity. In the event a user responds to a Service initiated message or email, the user may receive one or more further communications from said Service personnel or contractors. You understand, acknowledge and agree that no physical meeting will ever take place and that the aforesaid exchange of communications is for the purpose of your entertainment and amusement, to encourage broader participation and use of the Site and Services and/or to monitor user activities.

Article 13. Governing law

These Terms and Conditions shall be governed by the laws of Bulgaria without regard to conflict of law provisions. Any dispute, controversy, or claim arising out of or in connection with these Terms and Conditions, or the breach, termination or validity thereof, shall be submitted to the competent courts of Tallinn, Estonia.
